1. Scope
These terms and conditions apply to all contracts for transport, courier, freight-forwarding and related logistics services between TZ Time Zone Logistics GmbH, Donatusstr. 158, 50259 Pulheim (the “Contractor”) and the customer. Deviating customer terms apply only if the Contractor has expressly agreed to them in writing.
2. Formation of contract
Offers by the Contractor are non-binding unless expressly marked as binding. A contract is formed when the Contractor confirms the order in writing, electronically or by phone. Changes require confirmation by the Contractor.
3. Services
The scope of services follows from the relevant quote or order confirmation (including pickup/delivery locations, time windows, vehicle class, temperature control and add-ons). Delivery dates are non-binding unless expressly agreed as fixed deadlines.
4. Customer obligations
The customer must provide accurate shipment, address, time-window and special-requirement details, pack goods suitably for transport and make them available on time. The customer is liable for delays or damage caused by incorrect information or inadequate packaging.
5. Prices and payment
The prices stated in the quote or order confirmation apply, plus statutory VAT. Invoices are payable within the agreed period without deduction. In case of late payment the Contractor may charge default interest and reminder fees.
6. Liability
The Contractor’s liability follows applicable law and, where agreed, the ADSp as amended. Liability for intent or gross negligence is unlimited. Otherwise liability is limited to foreseeable, typical contractual damage to the extent permitted by law.
7. Insurance
Transport insurance beyond statutory or agreed liability is arranged only on express request and against a separate charge.
8. Final provisions
